Terms and Conditions

1. Who May Use the Services

You must be at least 18 years old and able to form a binding contract. By using the Services, you represent that you meet these requirements and that the information you provide is accurate.

2. What You Are Purchasing

Please read this section carefully — it defines what you are paying for.

Your subscription fee purchases (a) a reusable collection container/vessel and (b) a membership and scheduling service that allows you to reserve appointments and collect at our designated location during posted hours. Your fee is for the container and the associated membership and scheduling service. It is not a purchase of water as a commodity, and it is not a purchase of any health outcome or benefit.

Plans are sold in “Shares.” Each Share entitles you to collect one container of water per scheduled pickup, at appointments you schedule through our online calendar:

• One Share$65/month
• Two Shares$120/month
• Three Shares$150/month

3. Health Disclaimer

The statements and information provided in connection with the Services have not been evaluated by the U.S. Food and Drug Administration (FDA). The Services and any water collected are not intended to diagnose, treat, cure, or prevent any disease or health condition. Nothing provided by us is medical advice. Consult a qualified healthcare professional before making any decision that could affect your health, and before changing your water intake if you have a medical condition. You use the Services and consume any water at your own discretion and risk.

4. Scheduling and Collection

Appointments are booked through our online calendar and are subject to availability and posted pickup hours: Monday, Wednesday, and Friday: 8:00 AM–12:00 PM and 2:00 PM–6:00 PM at 671 Delechant Court Erie, CO 80516.

You are responsible for arriving during your scheduled window and for bringing/using the container in a clean, sanitary condition.

Water not collected within its applicable period is forfeited — there is no rollover, credit, make-up, or refund for missed or unbooked pickups. See the Subscription Terms and Cancellation Policy.

We may modify pickup hours, location, or availability, or temporarily suspend collection (for example, for maintenance, weather, or events outside our control). We will make reasonable efforts to notify you.

5. Container Care, Sanitation, and Assumption of Risk

You are responsible for the cleanliness, storage, handling, and sanitation of your container and any water after you collect it. Improper cleaning or storage can affect water quality and safety.

Once water leaves our designated location in your possession, its condition, storage, and use are your responsibility.

To the fullest extent permitted by law, you assume all risk arising from your collection, storage, handling, and consumption of water, and from your use of the container.

6. Payment

Fees are billed on a recurring monthly basis and processed by our third-party processor, Stripe. See the Subscription Terms for full billing, renewal, and cancellation details.

You authorize us and our processor to charge your payment method for all fees when due.

Prices are in U.S. dollars and may change on a going-forward basis with notice as described in the Subscription Terms.

7. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms;
• Resell, redistribute, or commercially exploit water collected, or transfer your subscription without our written consent;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or our systems;
• Provide false information or impersonate another person;
• Behave in an unsafe, abusive, or disruptive manner at the designated location.

We may suspend or terminate your access for any violation.

8. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

9. Intellectual Property

All content on https://h2watershare.agencytruenorth.com/home — text, graphics, logos, and branding — is owned by or licensed to Mizu Solutions LLC and is protected by law. You may not use it without our prior written permission.

10. Disclaimer of Warranties

To the fullest extent permitted by law, the Services, the container, and any water are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific health, wellness, hydration, or other outcome, or that the Services will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, in no event will Mizu Solutions LLC or its members, managers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to the Services, even if advised of the possibility. Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the total amount you paid to us in the three (3) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Mizu Solutions LLC and its members, managers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your handling, storage, or consumption of water.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause. Upon termination, your right to use the Services ends. Provisions that by their nature should survive (including Sections 3, 5, 10, 11, 12, and 15) will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new “Last Updated” date and, for material changes, provide notice by email or on the Services. Your continued use after changes take effect means you accept the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in located in , Colorado, and you consent to their jurisdiction. If any provision is found unenforceable, the remaining provisions remain in effect.
